Boozy Bakes Terms of Service
1. Acceptance of Terms
By placing an order with Boozy Bakes (“we,” “us,” or “our”), whether online or in-person, you agree to be bound by these Terms of Service (“Terms”). If you do not agree with these Terms, please do not place an order.
2. Eligibility
Our cupcakes contain alcohol and may not be suitable for persons under 21. By placing an order, you represent and warrant that you are 21 years of age or older.
3. Orders and Payments
All orders are subject to acceptance by Boozy Bakes. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing, or suspected fraudulent activity. Payment must be made at the time of order.
4. Shipping and Local Delivery
Shipping and delivery are subject to our Shipping Policy. Cupcakes are perishable; while we take care in packaging and shipping, once the product leaves our control, we are not responsible for delays, damage, or spoilage during transit, except as outlined in our Return & Refund Policy.
5. Intellectual Property
All content on our website, including but not limited to recipes, flavor names, descriptions, images, logos, and graphics, is the property of Boozy Bakes and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our express written permission.
6. Allergies and Dietary Restrictions
Products may contain or come into contact with common allergens, including but not limited to dairy, eggs, wheat, and nuts. Boozy Bakes is not responsible for allergic reactions. Please review ingredients and use your discretion before consumption.
7. Limitation of Liability
To the maximum extent permitted by law, Boozy Bakes’ liability is limited to the purchase price of the product. We are not liable for any indirect, incidental, consequential, or punitive damages, including but not limited to lost profits, personal injury, or property damage arising from the use or misuse of our products.
8. Governing Law
These Terms and any disputes arising from them shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles.

We reserve the right to modify or update these Terms at any time. Updated Terms will be posted on our website with a revised “Effective Date.” Continued use of our services constitutes acceptance of the revised Terms.
